1. In recognition of the risk of injury while participating in the Ruben Castro Charities Community 5K and Fun Run and as consideration for the right to participate in the Event, I hereby for myself, my heirs, executors, administrators, assigns or personal representatives knowingly and voluntarily enter into this waiver and release of liability (Agreement) and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Event, and do hereby release and forever discharge Ruben Castro Charities and all their affiliates, managers, members, agents, attorneys, employees, volunteers, heirs, representatives, predecessors, successors and assigns, business and its affiliates, managers, members, agents, attorneys, employees, volunteers, heirs, representatives, predecessors, successors and assigns, the event site and its agents, attorneys, employees, volunteers, heirs, representatives, predecessors, successors and assigns and all sponsors and/or beneficiaries of the Ruben Castro Charities and the Ruben Castro Charities Community 5K and Fun Run from any and all liability, claims, demands, damages, actions, or causes of action now existing or which hereinafter I may suffer arising out of, connected with, or in any way associated with the Event, race, program or activities, whether any injury or illness, including death or incapacity, is caused or associated with transportation to and from the event, the negligence of the Hosts, the negligence of myself or third parties, the conditions of the course or any other cause.
2. I agree that I am solely responsible for determining if I am physically fit and/or skilled for the race or activities contemplated by this Agreement. It is always advisable, especially if the participant is pregnant or disabled in any way or recently suffered an illness, injury or impairment, to consult a physician before undertaking any physical activity.
3. I certify that I am physically fit, have sufficiently trained for participation in this event and have not been advised otherwise by a qualified medical person.
4. I agree to indemnify and hold harmless Ruben Castro Charities against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by or against me, including attorney's fees, if litigation arises on account of claims made by or against me or against me in connection with my participation in the Ruben Castro Charities Community 5K and Fun Run.
5. I recognize that various photographs, video recordings, and other media will be taken during the Ruben Castro Charities Community 5K and Fun Run. I agree to grant Ruben Castro Charities full permission to use any photographs, video recordings or other media of the Ruben Castro Charities Community 5K and Fun Run that contain my likeness for the purpose of promoting Ruben Castro Charities or the Ruben Castro Charities Community 5K and Fun Run, or for any purpose deemed appropriate by the organization.
6. I acknowledge that this Agreement is the entire agreement between Ruben Castro Charities and me, that I cannot unilaterally change this Agreement and that this Agreement will not be modified or changed by verbal representations or statements of the Host.
7. I hereby declare that I have read and fully understand this Agreement in its entirety and that, by signing below, I agree to all of the terms and conditions contained in this Agreement. When registering online, my online agreement shall substitute for and have the same legal effect as an original form signature. PARTICIPATION WILL BE DENIED, if I have not accepted this Agreement before the start of the event. SecureFee™ Registration Cancellation Insurance is offered in most states.
